These Terms & Conditions ("Terms") govern the access to and use of the website, mobile applications,
and services (collectively, the "Platform") owned and operated by PENEX SERVICES PVT
LTD, a company incorporated under the Companies Act, 1956, having its registered office
at 1-75-5-11, Near Jagapathi Theatre, Pedana, Krishna District, Andhra Pradesh – 521366 (hereinafter
referred to as "Company", "we", "us", or "our").
By accessing, registering on, or using the Platform, you ("User", "you", "your") agree to be bound by
these Terms & Conditions and the Privacy Policy. If you do not agree, you must discontinue use of
the Platform immediately.
1. SCOPE OF SERVICES
The Company operates as a technology platform and service facilitator.
Currently, the Platform provides access to the following services through authorized third-party service
providers:
- Mobile Recharge
- DTH Recharge
- BBPS (Bharat Bill Payment System) bill payments
The Company does not itself provide telecom, utility, or banking services and does not guarantee
uninterrupted availability of third-party services.
Additional digital or financial services may be introduced in the future and shall be governed by updated
Terms & Conditions.
2. USER ELIGIBILITY
- Users must be 18 years of age or above.
- Users must have the legal capacity to enter into a binding contract.
- Users agree to provide accurate, complete, and updated information at all times.
- The Company reserves the right to suspend or terminate access if eligibility conditions are not met.
3. USER ACCOUNT & SECURITY
- Registered mobile number and/or email ID shall act as the unique user identifier.
- Users are solely responsible for maintaining the confidentiality of login credentials.
- The Company never asks for passwords, PINs, OTPs, or banking credentials.
- Any activity performed using the registered account shall be deemed to have been done by the User.
4. ACCOUNT VALIDITY & ACTIVITY REQUIREMENT
- Accounts are generally valid for one (1) year from the date of the last successful transaction.
- A minimum of one recharge or payment transaction every 90 days is required to keep the account
active.
- Accounts with no transaction activity for more than one year may be suspended or terminated.
5. USER CONDUCT
Users shall not:
- Use the Platform for unlawful, fraudulent, or abusive activities
- Violate DND or telecom regulations
- Use offensive, misleading, or harmful language
- Misuse the Platform for unauthorized B2C operations without prior approval
- Attempt to disrupt, reverse engineer, or exploit the Platform
Violation may result in suspension, termination, or legal action.
6. ACCOUNT SUSPENSION & TERMINATION
The Company reserves the right to suspend or terminate accounts without prior notice in case of:
- Violation of these Terms or Privacy Policy
- Illegal or suspicious activity
- Regulatory or compliance requirements
Any balance or credits, if applicable, may be forfeited in accordance with applicable laws and policies.
7. PRICING & CHANGES
- Pricing, service charges, margins, or surcharges may change from time to time.
- Changes may be due to operator, regulatory, or business reasons.
- Completed transactions shall not be affected by future pricing changes.
8. PAYMENTS & BILLING
- Payments are accepted only through authorized banking channels such as UPI and IMPS.
- Payments from unauthorized or third-party sources may be rejected.
- Billing services are available 24x7, subject to partner availability.
9. REFUND, REVERSAL & TRANSACTION POLICY
PENEX SERVICES PVT LTD acts as a platform facilitator and does not independently control transaction
outcomes.
Successful Transactions
Transactions marked as successful by the service provider are final and non-reversible.
Failed or Pending Transactions
Refunds or reversals, if applicable, shall be processed strictly as per confirmation and timelines
provided by the respective service provider, bank, BBPS system, or payment gateway.
Third-Party Dependency
- Refund eligibility is subject to third-party rules and settlement processes.
- Delays may occur beyond the Company's control.
No Cash Refunds
Cash refunds are not offered.
Eligible refunds, if approved, shall be processed through the original mode of transaction or as per
applicable system rules.
Regulatory Compliance
Refunds mandated by applicable laws, regulatory authorities, or court orders shall be processed
accordingly.
10. TRANSACTION STATUS TIMELINES
- Mobile Recharge: Instant (subject to operator confirmation)
- BBPS Services: Up to T+2 working days
- Other Services: Up to T+1 working day
Final transaction status depends on the respective service provider.
11. SECURITY & MONITORING
- The Company may log IP addresses, device information, and geolocation for security and compliance.
- Suspicious or illegal activities may lead to account suspension and legal action.
12. INTELLECTUAL PROPERTY
- All content, software, design, graphics, trademarks, and logos on the Platform are the exclusive
property of PENEX SERVICES PVT LTD.
- Unauthorized use is strictly prohibited.
13. LIMITATION OF LIABILITY
Use of the Platform is at the User's own risk.
The Company shall not be liable for:
- Service provider failures
- Network or technical issues
- Incorrect user inputs
- Events beyond reasonable control
14. INDEMNIFICATION
Users agree to indemnify and hold harmless PENEX SERVICES PVT LTD and its affiliates from any claims,
losses, penalties, or legal expenses arising from violation of these Terms, Privacy Policy, or
applicable laws.
15. GOVERNING LAW & JURISDICTION
- These Terms shall be governed by the laws of India.
- All disputes shall be subject to the exclusive jurisdiction of courts at Pedana, Andhra Pradesh.
16. UPDATES TO TERMS
- The Company may update these Terms from time to time.
- Continued use of the Platform after updates constitutes acceptance of the revised Terms.
